This Privacy Policy is a comprehensive legal document governing the collection, use, and protection of personal data by Amplis LLC (“Company”, “we”, “us”, or “our”).

1. SCOPE AND INTERNATIONAL COMPLIANCE

This Global Privacy Policy applies to all services provided from the Company via the Cash Clawee application and website. We operate in diverse jurisdictions and are committed to complying with the following frameworks:

  • North America: Including CCPA/CPRA (California), VCDPA (Virginia), and any other relevant US Federal guidelines.
  • Global Standards: Principles of transparency, data minimization, and purpose limitation.

2. DATA WE COLLECT: CATEGORIES AND SOURCES

2.1 User-Provided Data

During account registration and service usage, we collect the following:

  • Contact Information: Primary E-mail address and verified Phone number.
  • Verification Data (IDComply Suite): Through our integration with IDComply, we collect full legal First Name, Last Name, and the Last 4 digits of your Social Security Number (SSN).
  • Residential Verification: Physical address details including Street name, Building/Apartment number, City, State, ZIP code, and Country.

2.2 Automated Data Collection (Operational Requirements)

To ensure compliance with the Game Rules and Terms of Service, we automatically collect data regarding your device and location. As outlined in the TOS, our ‘Real Money Skill Gaming’ application requires precise geolocation to verify you are in a permitted jurisdiction.

  • Device ID and IP Address.
  • Geolocation Data (GPS, WiFi, and Cell Tower info).
  • In-Game Interaction Data: Including claw movements, prize attempts, and session duration.

3. THE KYC (KNOW YOUR CUSTOMER) PROCESS

As a Real Money Skill Gaming App, we are legally required to verify the identity of every player.

3.1 Mandatory Affirmation

Before any real-money transaction or gameplay can occur, the player must confirm they agree to check their data. By providing your SSN digits and address, you provide explicit consent for IDComply to run your data against authoritative databases. This check may include your:

  • E-mail
  • Phone number
  • First name
  • Last name
  • Last 4 digits of SSN
  • street name
  • building/apart number
  • city
  • state
  • ZIP code
  • country

4. OPERATIONAL PROCESSING REQUIREMENTS

Based on the Terms of Service (TOS) and Game Rules, your data is processed for the following operational needs:

  • Prize Fulfillment: Using your residential address to ship physical prizes won via the claw machine.
  • Skill Verification: Monitoring gameplay to ensure compliance with ‘Skill Gaming’ definitions and detecting automated scripts (bots).
  • Restricted Jurisdictions: Using geolocation to block access in states or countries where real-money skill gaming is prohibited.

5. LEGAL BASIS FOR DATA PROCESSING

We process your data under several legal pillars:

Legal Obligation

Processing is necessary for compliance with legal obligations to which we are subject to. This includes, but is not limited to, Anti-Money Laundering (AML) regulations, and tax reporting requirements.

Contractual Necessity

Processing is necessary for the performance of a contract to which you are a party, such as the Terms and Conditions of our service, or in order to take steps at your request prior to entering into a contract.

Legitimate Interest

Processing is based on our legitimate business interests, provided these are not overridden by your rights and interests. Our legitimate interests include service improvement, website security, and fraud prevention. You have the right to object to processing based on legitimate interest by contacting support@cashclawee.com.

Consent

In specific cases, such as marketing or certain types of website tracking, we process data based on your explicit consent. You have the right to withdraw your consent at any time, which will not affect the lawfulness of processing based on consent before its withdrawal.

6. DATA RETENTION AND ARCHIVING

We do not keep data longer than necessary. However, legal requirements necessitate specific timelines:

  • Verification Records: Retained for 7 to 10 years following account closure to comply with financial audits.
  • Game Logs: Retained for 2 years to resolve any disputes regarding prize wins.

7. USER RIGHTS AND ACCESS REQUESTS

As a data subject you have the following rights:

  • Right of Access: Request a copy of the personal data we hold about you.
  • Right to Rectification: Correct any inaccurate or incomplete personal data.
  • Right to Erasure (‘Right to be Forgotten’): Request deletion of your data when it is no longer necessary for the purposes it was collected.
  • Right to Restriction: Request that we limit the processing of your data in specific circumstances.
  • Right to Object: Object to processing based on legitimate interests or for direct marketing.
  • Right to lodge a complaint with the Competent Regulator

8. THIRD-PARTY DISCLOSURES

We may share your data with:

  • Competent authorities (such as Tax Authority, Law Enforcement);
  • Group companies for centralized operational purposes;
  • IT and storage providers (e.g., AWS);
  • Professional advisors (lawyers, auditors) under strict confidentiality agreements.

To provide our services, we may share your information with trusted third-party vendors, service providers, and partners (such as cloud hosting providers, payment processors, and analytics services). When these third parties are located outside your home jurisdiction we ensure that your data is protected by a level of security essentially equivalent to that guaranteed under applicable local laws.

We implement strict legal safeguards whenever there is a transfer of personal data to another country, like:

  • Standard Contractual Clauses (SCCs) approved by the European Commission when we might need to transfer your personal data to any EU country.
  • Transfer Impact Assessments (TIAs): We conduct routine assessments of the legal regimes in recipient countries to ensure that local laws do not undermine the protections provided by our contractual clauses.

Note: By using our services, you acknowledge that your personal data may be transferred to and processed in countries where privacy laws may be different from those in your jurisdiction. We remain responsible for ensuring these transfers comply with all applicable legal requirements.

9. DATA SECURITY AND ENCRYPTION STANDARDS

We implement appropriate technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption protocols, secure servers, access controls, and regular security assessments. Despite our efforts, no method of transmission over the internet is entirely secure, and we cannot guarantee absolute security.

10. CHANGES TO THIS POLICY AND CONTACT INFORMATION

We reserve the right to modify this Privacy Policy at any time to ensure it remains compliant with legal requirements and reflects our current data practices. Any changes will be communicated exclusively by publishing the latest version directly on our website. The “Last Updated” date at the top of the policy will indicate when the most recent revisions were made.
